Pholiofy is committed to protecting your personal information and respecting your privacy. In general, you can visit Pholiofy.com without telling us who you are or revealing any information about yourself.
Pholiofy will never sell, rent or disclose your personally identifiable information to outside parties without your consent unless compelled by law or court order to do so. With your permission, Pholiofy may send you e-mail regarding our new products, upgrades or special discounts.
Information That We Gather and Track
There are times when we may need to collect information from you through our Web site. This generally involves filling out forms so you can subscribe to an use the Pholiofy service. When you sign up for the trial or a paid subscription, we require you to fill out a form with your name and email address.
Pholiofy uses various methods to collect certain other kinds of information, including:
- Cookies
- Referers
- IP addresses
- System information
None of these methods can be personally identified with you with the exception of cookies, which can optionally store information that you may enter in forms on our Web site, as described below.
Pholiofy may use Globally Unique Identifiers (GUIDs) to notify us of the installation of one of Pholiofy products.
A “cookie” is an element of data that a Web site can send to your browser, which may then store it on your system. It can be used to provide you with a tailored user experience. Some Pholiofy pages use cookies. Cookies are used to better personalize the content, banners and promotions that you and other users will see. We may use the information to research and understand how our users’ habits in the aggregate are similar or different so that we can enhance your experience on the Pholiofy site and with our products. With your consent, cookies can optionally store information from forms that you fill out on our site so that next time you visit, you do not have to re-enter this information.
A “referer” is the information passed along by a web browser that references the Web URL you linked from, and is automatically collected by our Web server. This information is collected and used by Pholiofy to understand the web sites referring traffic to our download pages and to present appropriate content to our potential customers. Referer information is tabulated by Pholiofy on an aggregated basis to identify general trends and traffic patterns.
From time to time, Pholiofy may enter into agreements with content partners that require Pholiofy to count the number of sales stemming from a referral from a content partner site. This information is collected, used and aggregated by Pholiofy to fulfill the reporting requirements of those agreements. This information may also be combined with the referer information described above and tabulated on an aggregated basis to identify general trends and traffic patterns. At the time of product download and/or purchase, information you provide to Pholiofy including personal information and referring URL’s, is collected in our web server logs and customer database and is kept strictly confidential and not shared with third parties.
IP addresses are used by your computer every time you are connected to the Internet. Your IP address is a number that is used by computers on the network to identify your computer so that data (such as the Web pages you request) can be sent to you. They are automatically gathered by our Web server. Pholiofy will not use your IP address to attempt to identify your personal information.
System information we gather includes time, type of Web browser being used, the operating system/platform, and CPU speed. This information is sent automatically by your Web browser when you are connected to a Web site and is used by Pholiofy only for broad demographic statistics. This information is used by Pholiofy in identifying broad demographic trends and may be used to provide information appropriate for your computer system. You will not be personally identified from this information.
What We Do With the Information We Gather and Track
The personally identifiable information gathered from the forms you fill out on our Web site is used in one of three ways:
- to provide you with information or to ask you to participate in surveys about products, services, news and events,
- to allow you to purchase and subscribe to the service; and
- to aggregate broad demographic information in order to understand general user trends.
Pholiofy retains the services of certain outside contractors to perform services on our behalf. At times, we must disclose relevant information about our customers to our contractors so they may provide specific services for Pholiofy.
Pholiofy requires such contractors to keep your information strictly confidential and to use the information solely on behalf of Pholiofy For purposes of this Privacy Statement, such contractors are not considered “third parties” and Pholiofy may disclose personally identifiable information to such contractors without additional notice.
In addition, the Pholiofy Web sites contain links to other Web sites. However, Pholiofy is not responsible for the privacy practices or the content of such Web sites.
What We Do with Information Gathered When You Acquire Third Party Products
Pholiofy will never sell, rent or disclose to third parties our users’ personally identifiable information collected from the distribution of Pholiofy products or gathered on a Pholiofy Web site. If you purchase a product or service developed or owned by a third party, Pholiofy may provide to the product owner or licensor the same information you provide to us.
Special Third Party Relationships
On occasion, Pholiofy will offer our product users and web site visitors the opportunity to participate in third party or co-branded promotions, sweepstakes or special programs.
The use of any information provided by a user in entering such a third party promotion will be specified prior to the user providing such information. We will also specify the manner in which such information is to be used. If your personal information is to be shared with a third party, it will only be done so with your advance informed consent.
These relationships will be clearly identified by Pholiofy.
The privacy policy or policies governing such third party promotions and/or co-branded programs will be specified.
Communications to our Constomers
In addition to product update, promotional and informational e-mails that Pholiofy sends to its users from time to time, we may, on occasion, invite you to participate in a focus group, phone survey or send you postal mail.
You may always opt-out of receiving such mail by clicking on the link provided at the bottom of our e-mail to you.
Once you supply us with personal information, such as an e-mail address, Pholiofy does not change the manner of usage of such information from its original purpose, unless we first obtain your informed consent.
Security of Personal and Payment Information
Pholiofy maintains controls to provide security over certain financial information you provide us, including credit card details, during the purchase process. This is evidenced through:
The use of secure connections using SSL to safeguard information when transmitted from the customer’s web browser to Pholiofy. We do not store credit card numbers
Pholiofy employees are required to acknowledge that they understand and will strictly abide by our corporate policies with respect to the confidentiality of user personal information.
Pholiofy only gives access to databases containing personal information to employees on a need to know basis. Passwords are regularly changed pursuant to security protocols. Our security procedures are reviewed on at least a quarterly basis.
Changes to our Privacy Policies
We revise our Web Site Privacy policy to keep it up to date with Pholiofy products, services and web pages. We also post FAQ’s from time to time on specific products.
Pholiofy will use reasonable efforts to comply with this privacy statement and will take prompt corrective action when it learns of any failure to comply with its privacy statement. Because of the complex and constantly changing nature of our technology and business, Pholiofy does not guarantee error-free performance under this privacy statement. Pholiofy shall not be liable for any incidental, consequential or punitive damages relating to this privacy statement.
